LICENCE-INVARIANT DEFINITIONS 1.1 Copyright Holder The 'Copyright Holder' is the person or entity who created or originated the Work, or such person or entity to whom the creator or originator has assigned the copyright of the Work. 1.2 Distribution A 'Distribution' is a collection of material assembled and/or distributed and/or made available by User which includes the Work, in whole or in part, either alone or in combination with other material from the same, other, or multiple origins. 1.3 Licence The 'Licence' is the grant of permissions and rights set forth in Section 3 of this document. 1.4 Licensor The 'Licensor' is the person or entity granting this Licence. 1.5 Marks The 'Marks' are service, trade, or other marks owned by the Copyright Holder, Licensor, or other person or entity. 1.6 Relevant Marks A 'Relevant Mark' is a Mark that explicitly references the Work or is identical with the Work's name. 1.7 User A 'User' is any person or entity to which the Licence is granted. 1.8 Work The 'Work' comprises the entire aggregation of material, such as software, documentation, or intellectual property, to which this licence document applies. 1.9 Substantive Identity If modifications made to the Work do not affect its functionality in any way, the modified Work is considered to be 'Substantively Identical' to the unmodified Work. Examples of modifications that do not affect the Substantive Identity of the Work include but are not limited to: o Changes that are necessary to port the Work to User's platform; o Changes that select a different set of the build options available for the Work; Examples of modifications that invalidate Substantive Identity with the Work include but are not limited to: o The addition of features that are not available in the Work; o The removal or behavioural alteration of features of the Work; o The introduction of bugs and/or flaws that are not present in the Work; o The correction or removal of bugs or flaws from the Work. 2. LICENCE Licensor hereby grants to User a non-exclusive, world-wide, royalty-free licence to the Work under the following inclusive terms and conditions. 3.1 Modification User may freely modify the Work and retain or distribute such modifications according to the terms of Section 3.2 of this Licence. Only Section 2 of this document may be modified; all other portions must remain intact and unaltered. 3.2 Copying, Redistribution, and Inclusion User may freely redistribute the Work, in whole or in part, in its original or modified form, as a standalone offering or included as part of a Distribution, for gratis, cost, or profit, subject to the terms of the Licence. If the Work is software, a Distribution may or may not include source code at User's discretion; inclusion of source code is not required by the Licence. This patent licence applies only to patented technology owned by Licensor and utilised by the Work. 3.8 Patent Disclaimer Licensor provides no assurances that the Work does not infringe the patent or other intellectual property rights of any other person or entity. Licensor disclaims any and all liability to User for claims brought by any other person or entity based on infringement of intellectual property rights or otherwise. As a condition precedent to exercising the rights and licences granted hereunder, User hereby assumes sole responsibility to secure any other intellectual property rights or permissions needed to use, modify, redistribute, perform, or otherwise utilise the Work. For example, if a third party patent licence is required in order for User to distribute the Work, it is User's responsibility to acquire that licence before distributing the Work. End of Licence
